Supreme Court Limits "machine-or-transformation test" in Bilski

The U.S. Supreme Court has decided that the "machine-or-transformation test" is an “investigative tool” but “not the sole test for deciding whether an invention is a patent-eligible process.” The Court further decided that while the patent law “appears to leave open the possibility of some business method patents, it does not suggest broad patentability of such claimed inventions.” The Court affirmed the rejection of a patent application which includes a claim to a "method for managing the consumption risk costs of a commodity sold by a commodity provider at a fixed price comprising the steps of ...." because it is not a patentable process.
